1. Introduction

Welcome to Facemaxx, operated by SERN (“Company”, “we”, “our”, or “us”).

By downloading, accessing, or using the Facemaxx mobile application and related services (“App” or “Services”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use Facemaxx.

2. App Purpose

Facemaxx is an AI-powered facial analysis, photo feedback, and lifestyle insight application.

Facemaxx provides features such as facial proportion analysis, aesthetic analysis, glow-up coaching, look archetype analysis, best photo selection, best angle guidance, dating profile scoring, and Instagram profile scoring.

The App is intended for entertainment, lifestyle, self-improvement, and informational purposes only.

3. No Medical, Psychological, or Professional Advice

Facemaxx is not a medical, psychological, dermatological, cosmetic surgery, or professional advisory service.

No Medical Advice: The App does not provide medical advice, diagnosis, treatment, or healthcare recommendations.
No Psychological Advice: The App does not diagnose or treat mental health, body image, self-esteem, or psychological conditions.
No Cosmetic Surgery Advice: The App does not recommend surgery, medical procedures, or clinical treatments.
Informational Use Only: Any scores, analysis, summaries, suggestions, or recommendations are for general informational and entertainment purposes only.
Consult Professionals: If you have health, skin, cosmetic, psychological, or medical concerns, you should consult a qualified professional.

You understand and agree that you use the App’s analysis and recommendations at your own discretion and risk.

4. AI Limitations

Facemaxx may use artificial intelligence and automated analysis systems to generate reports and suggestions.

AI-generated outputs may be incomplete, inaccurate, subjective, inconsistent, or not suitable for your personal circumstances. Results may vary depending on photo quality, lighting, angle, facial expression, camera lens, pose, and other factors.

Facemaxx does not guarantee that any analysis, score, recommendation, or result is accurate, objective, or applicable to real-world outcomes.

5. User Accounts

To use certain features, you may need to create an account or sign in through a supported authentication provider.

You agree to:

Provide accurate and complete information
Keep your login credentials secure
Be responsible for all activity under your account
Notify us if you suspect unauthorized account access
Use the App only in compliance with these Terms and applicable laws

6. Photos, Images, and User Content

You may upload, capture, or submit photos and other content to use the App’s features (“User Content”).

You retain ownership of your User Content. By submitting User Content, you grant SERN a limited, non-exclusive, worldwide license to process, analyze, transmit, display, and use that content solely for the purpose of operating, providing, improving, securing, and supporting the App.

You represent and warrant that:

You own or have permission to use any photo or content you submit
You will not upload photos of another person without appropriate consent
You will not upload illegal, harmful, abusive, explicit, or infringing content
Your User Content does not violate any third-party rights or applicable laws

We may remove or restrict content if we believe it violates these Terms, applicable law, or the rights or safety of others.

7. Facial Analysis and Results

Facemaxx may generate analysis results, scores, categories, summaries, or recommendations based on the photos and information you provide.

You understand that:

Results are not official evaluations
Results are not medical, biometric identification, or professional assessments
Results may be affected by photo quality and other conditions
Results are provided for entertainment, lifestyle, and informational purposes
You should not make important medical, financial, legal, cosmetic, or personal decisions based solely on the App’s results

8. Subscriptions, Purchases, and Payments

Facemaxx may offer paid features, subscriptions, consumable credits, or premium access.

If you purchase a subscription or paid feature:

Payment will be charged through the Apple App Store or other applicable platform.
Subscriptions may automatically renew unless canceled before the renewal date.
You are responsible for managing or canceling subscriptions through your Apple App Store account settings.
Refunds are handled by Apple or the applicable platform according to their refund policies.
We do not directly process App Store refunds.

Prices, features, and subscription terms may change from time to time. Any changes will apply as permitted by the applicable platform rules and law.

9. Acceptable Use

You agree not to:

Use the App for unlawful, harmful, abusive, or fraudulent purposes
Upload content that violates another person’s privacy, publicity, intellectual property, or other rights
Upload photos of minors or other individuals without appropriate consent
Use the App to harass, shame, bully, discriminate against, or harm others
Reverse engineer, decompile, modify, or attempt to extract source code from the App
Interfere with or disrupt the App, servers, networks, or security systems
Use automated systems, bots, scraping, or similar methods without permission
Misrepresent App results as professional, medical, legal, or official assessments
Use the App in a way that violates applicable laws or regulations

10. Intellectual Property

The App, including software, design, user interface, graphics, logos, trademarks, text, features, analysis systems, and other content, is owned by SERN or its licensors and is protected by intellectual property laws.

These Terms do not transfer any ownership rights to you. You are granted a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

11. Third-Party Services

Facemaxx may rely on third-party services for hosting, analytics, authentication, payments, customer support, AI processing, or other features.

Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services except as required by applicable law.

12. Privacy

Your use of Facemaxx is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, store, and protect your information.

By using the App, you agree that we may process your information as described in the Privacy Policy.

13. Disclaimers

Facemaxx is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, non-infringement, availability, or error-free operation.

We do not guarantee that:

The App will always be available, secure, or error-free
Any analysis result will be accurate or useful
The App will meet your expectations
Defects or errors will be corrected immediately
The App will be compatible with every device or operating system

14. Limitation of Liability

To the fullest extent permitted by law, SERN shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of data, loss of profits, emotional distress, reputational harm, personal dissatisfaction, or decisions made based on App results.

You agree that your use of the App and reliance on any results or recommendations is at your own risk.

Nothing in these Terms limits liability that cannot be excluded or limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless SERN from and against any claims, damages, losses, liabilities, costs, and expenses arising from:

Your use or misuse of the App
Your User Content
Your violation of these Terms
Your violation of applicable law
Your violation of any third-party rights

16. Account Suspension or Termination

We may suspend, restrict, or terminate your access to the App if we believe that:

You violated these Terms
You used the App unlawfully or abusively
Your actions may harm other users, us, or third parties
Suspension is necessary for security, legal, or operational reasons

You may stop using the App at any time. You may also request account deletion according to the Privacy Policy and in-app account settings where available.

17. Changes to the App

We may update, modify, suspend, discontinue, or remove features of the App at any time. We may also add or remove free or paid features.

We are not liable for any modification, suspension, or discontinuation of the App or any feature, except as required by applicable law.

18. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Last Updated” date at the top of this page.

Your continued use of Facemaxx after updated Terms become effective means you accept the revised Terms.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Korea, without regard to conflict of law principles.

20. Dispute Resolution

If a dispute arises between you and SERN, both parties agree to first attempt to resolve the dispute through good-faith communication.

If the dispute cannot be resolved informally, it shall be handled by the competent courts of the Republic of Korea, unless otherwise required by applicable law.
